Prayer in this writ petition is for declaring that levy of 10% amount under Rule 6(3)(b) of Cenvat Credit Rules, 2004 is violative of Article 14, 265 and 300-A of the Constitution of India as well as Section 37 of Central Excise Act, 1944.
2. None had appeared on behalf of petitioner on last date of hearing and this petition had been posted for today under the caption ‘for dismissal’. Today again, there is no representation on behalf of petitioner who it appears is not interested in pursuing the matter any longer.
