We have heard the learned Counsel for the parties.
After the settlement talks the Appellant has decided to agree for option “A”. The same has been reported today to this Tribunal.
In view of the above, it would be appropriate to direct the parties to approach the Commission for fixing the tariff. Accordingly, directed.
Respondent undertakes that they would file the necessary application before the Commission within two weeks from today i.e. on 16.12.2010. This process shall be completed within two months from the date of the receipt of the Application. With these observations, this Appeal is disposed of.
