WRIT APPEAL NO: 424 of 2026 Bench Sr.No:-4
Poosarla Subba Rao and others ...Appellants Vs. The Union of India and others ...Respondents ********** Advocate for Appellants : Ms K Indu representing Mr K L N Swamy Advocate for Respondents : Mr Jupudi V K Yagnadutt (Central Government Counsel)
CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R RAGHUNANDAN RAO DATE : 16th April, 2026 P C :
We have heard learned counsel for the parties.
2. We are of the opinion that the judgment and order impugned requires to be set aside as some of the issues would have still remained alive notwithstanding the fact that the period of lease had since come to an end and had not been extended. The appellants herein did have the right to contest the liability which may accrue during the subsistence of the lease period.
3. We, therefore, set aside the judgment and order impugned and restore the writ petition to its original number to be heard by the learned single Judge afresh.
HCJ & RRR, J WA_424_2026
4. The Writ Appeal is, accordingly, allowed. No order as to costs.
Registry is directed to list WP.No.5630 of 2017 before the appropriate Bench having Roster.
Miscellaneous applications pending, if any, shall stand closed.
