The Court made the following order:
Assailing the correctness and legality of the order and decree, dated 29.04.2025 passed in Interlocutory Application No.400 of 2024 in Original Suit No.554 of 2015 on the file of the Court of VII Additional District Judge, Visakhapatnam, the present Civil Revision Petition is filed under Article 227 of the Constitution of India.
2. Ms. Y.Bhanusri Akhila, learned counsel, representing Sri Patanjali Pamidighantam, learned counsel for the petitioner, submits that inadvertently, counsel’s affidavit has been filed in support of the said Interlocutory Application, as the petitioner is residing abroad. At the time of making submissions before this Court, the same was noticed and therefore seeks permission of this Court to withdraw the I.A.No.400 of 2024, with liberty to file a fresh Interlocutory application before the Court below in proper prescribed manner under law.
3. Heard Sri Meka Rahul Chowdary, learned counsel for the respondents and he prayed to pass appropriate orders.
4. Permission, as sought for by the learned counsel for the petitioner, is accorded.
4. Accordingly, the Civil Revision Petition is disposed of permitting the petitioner to withdraw Interlocutory Application No.400 of 2024 in Original Suit
No.554 of 2015 on the file of the Court of VII Additional District Judge, Visakhapatnam by granting liberty to the petitioner to file a fresh Interlocutory application before the Court below in the prescribed manner under law. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
