THE HON’BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY AND THE HON’BLE SRI JUSTICE TUHIN KUMAR GEDELA WRIT PETITION No.8404 of 2026 O R D E R: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy)

This writ petition is filed seeking implementation of the order dated 04.04.2013 passed in O.A.No.2358 of 2013 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad.

2. Heard learned counsel for the petitioner and learned Government Pleader for Services-III appearing for the respondents.

3. Certain School Assistants/Secondary Grade Teachers in Anantapur District filed the aforesaid O.A.No.2358 of 2013 before the Andhra Pradesh Administrative Tribunal, Hyderabad, seeking direction to the respondents therein to fix their pay in 1993 PRC and also for a consequential direction to give the right of option to them to opt their choice in 1999 PRC while fixing the basic pay at Rs.4,070/- per month, which is corresponding to the scale of Rs.2,075/- per month which accrued to them in 1993 PRC scales. The writ petitioner is applicant No.35 in the said O.A. The said O.A. was disposed of at the admission stage itself in terms of the earlier order passed in O.A.No.8337 of 2010 & batch dated 19.12.2012, with a direction to the Director of School Education, who is the 3rd respondent therein, to give instructions to the concerned District Educational Officer to release the benefits of PRC 1999 by taking into consideration the pay of the applicants at Rs.2,075/- in 1993 PRC and to release the monetary benefits within a period of two months from the date of receipt of copy of the said order.

4. Now, the grievance of the writ petitioner is that till now the said order has not been complied with and the respondents have flouted the directions of the Tribunal.

5. Admittedly, the aforesaid order passed by the Tribunal was not challenged by the respondents and it became final. Therefore, they are bound to implement the said order.

6. Learned Government Pleader for Services-III requests two months time to comply with the order of the Tribunal.

7. Therefore, the writ petition is disposed of with a direction to the respondents, particularly to respondent No.6 - District Educational Officer, Anantapur District, to comply with the order of the Andhra Pradesh Administrative Tribunal, dated 04.04.2013, passed in O.A.No.2358 of 2013 within a period of two months from the date of this order.

As a sequel, interlocutory applications, if any pending, in this case shall stand closed. There shall be no order as to costs.
