ORDER:
This contempt case is filed for non implementation of the order dated 22.07.2022, passed by this Court in W.P.No.21944 of 2022.
2. After notice, the 3rd contemnor has filed reply affidavit annexing the order dated 27.05.2023 wherein it has been stated that the matter involves controversial question of facts and therefore, it was appropriate to reject the request of the petitioner and his claim for issue of NOC and de-notification of the land in Sy.No.351/1 measuring Ac.3.00 cts deserves no consideration and accordingly the claim was rejected. .
3. On perusal of the same, this Court is of the view that there is no willful disobedience of the order dated 22.07.2022, passed by this Court in W.P.No.21944 of 2022.
4. Accordingly, the contempt case is closed giving liberty to the petitioner to question the order dated 27.05.2023, passed by the 3rd contemnor, if so aggrieved. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
