ORDER:

The instant Criminal Revision Case is filed under Sections 438 and 442 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) seeking to set aside the order dated 04.04.2024 passed by the learned Sessions Judge, Mahila Court, Visakhapatnam in Crl.M.P.No.39 of 2023 in Crl.A.No.548 of 2023.

2. Heard Sri K.Muni Reddy Bala Prasad, learned counsel for the Petitioner.

3. Learned counsel for the Petitioner would submit that this revision is preferred against the order dated 04.04.2024 in Crl.M.P.No.39 of 2023 in Crl.A.No.548. It is further submitted that in D.V.C.No.24 of 2015 an amount of Rs.10,000/- per month was granted as maintenance apart from the compensation. When the Petitioner filed Crl.M.P.No.39 of 2023 setting stay of the order passed by the trial Court, the said petition was dismissed by the learned Appellate Judge. Learned counsel would further submit that the Petitioner is visually challenged and working in Electricity Department, Andhra University. It is further submitted that, apart from the maintenance granted in D.V.C., Rs.10,000/- per month was also granted in the Maintenance Case. It is submitted that a direction may be given to the Appellate Court for expeditious disposal of the appeal if this Court is not inclined to interfere in the impugned order.

4. Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor is in attendance.

5. Considering the submissions made, since the main appeal is pending before the Appellate Court, the Criminal Revision Case is disposed of and the learned Appellate Judge is directed to disposal of Crl.A.No.548 of 2023 as expeditiously as possible, but not later than two months from the date of receipt of copy of this order.

Pending applications, if any, shall stands closed. ________________________________________ Dr.JUSTICE VENKATA JYOTHIRMAI PRATAPA Date:02.04.2026 Dinesh
