...RESPONDENT(S):

The Court made the following ORDER:

1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue any appropriate writ, order or direction, preferably one in the nature of Writ of Mandamus declaring the action of the respondents in not considering the case of the petitioner for promotion to the post of Nursing Superintendent Grade-I, ESI hospital, Tirupati, Tirupati district, Andhra Pradesh, without filling up of the said post with promotion since more than an year despite of her representations since April 2025 to her last representations dated 25.11.2025 to 01.03.2026, though she is the senior most eligible candidate with requisite qualifications , as being illegal, unjust and in violation of Article-14, 16 and 21 of the constitution of India and consequently direct the respondents to consider the case of the petitioner for promotion to the post of Nursing Superintendent Grade-I, E.S.I hospital at Tirupati, Tirupati District, Andhra Pradesh by issuing the order of promotion and to pass…”

2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

3. The grievance of the petitioner is that the respondents have not considered the case of the petitioner for promotion to the post of Nursing Superintendent Grade-I in ESI Hospital Tirupati, despite the fact that the said post has remained vacant for more than one year. The petitioner contends that she is the senior-most eligible candidate possessing the requisite qualifications and has been submitting representations from April 2025 onwards, including her latest representations dated 25.11.2025 and 01.03.2026, requesting the respondents to consider her case for promotion. However, no action has been taken by the respondents on the said representations.

4. Considering the same and upon perusal of the material available on record, this Court is of the opinion that the writ petition can be disposed of by directing the respondents to consider the case of the petitioner for promotion to the post of Nursing Superintendent Grade-I in ESI Hospital Tirupati, in the light of her representations dated 25.11.2025 and 01.03.2026, and pass appropriate orders in accordance with law within a period of two (02) months from the date of receipt of a copy of this order.

5. Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
