ORDER:

The instant Criminal Revision Case under Sections 397 and 401 of Cr.P.C has been filed by the Petitioner / husband seeking to set aside the

Order dated 17.05.2019 passed in M.C.No.17 of 2014 on the file of the Court of Judicial Magistrate of First Class, Palasa.

2. Heard Sri P.Kasi Nageswara Rao, learned counsel for the Petitioner / Husband.

3. Learned counsel for the Petitioner / Husband would submit that the impugned order is unsustainable in law. Respondent No.2 / wife had left the matrimonial home without informing the Petitioner. It is further submitted that, it is clear from Exs.R.1 to R.11 that the Petitioner has been maintaining his wife and children. Learned counsel would further submit that, except stating that the Petitioner has been working as a Software Engineer and earning Rs.1,00,000/- per month, no proof has been filed by the Respondent / Wife to prove the income of the Petitioner.

4. Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor is in attendance.

5. Considering the submissions made and on perusal of the record, this Court finds that, the learned trial Judge, taking into consideration the income and obligation of the Petitioner / Husband to maintain his wife and children and the inability of Respondents / Wife and children to maintain themselves and their necessities and on appreciation of the material placed on record, has rightly granted maintenance of Rs.10,000/- per month to each of the Respondent. This Court does not find any illegality, perversity, or material irregularity in the order warranting interference in revision.

6. Accordingly, the Criminal Revision Case is dismissed confirming the Order dated 17.05.2019 passed in M.C.No.17 of 2014 on the file of the Court of Judicial Magistrate of First Class, Palasa.

Pending applications, if any, shall stand closed. _________________________________________ Dr.JUSTICE VENKATA JYOTHIRMAI PRATAPA Date:01.04.2026 Dinesh
