JS,J W.P.No.9473/2019

The Court made the following ORDER:

When the matter was taken up for hearing, there was no representation for the petitioner.

2. Learned AGP submits that the writ petition has been filed with a prayer to direct the authorities to dispose of the representations dated 11th February 2019, regarding proposals to issue house sites in survey numbers 133/1 and 138, located at Panakam Village, Tirupati Rural Mandal, Chittoor District.

3. The Learned Assistant Government Pleader submits that the counter- affidavit filed by the 4th respondent explicitly states that there is no proposal to issue house-site pattas for Sy.No. 133/1 and 138 of Panakam Village, Tirupati Rural Mandal, because the subject lands are Kalva Poramboke. He has requested that this statement be recorded and that the writ petition be closed.

4. In view of the submissions in counter-affidavit filed by the respondent that the subject land is classified as kalavaporamboku and that there are no proposals for the insurance of house site pattas in survey number x x, this court, without expressing any opinion on the merits of the case, grants liberty to the petitioner to submit a fresh representation regarding their grievance. Upon receipt of such representation, the respondents are directed to consider and pass appropriate orders in accordance with law. With the above observation, repetition is disposed of.

As a sequel, any miscellaneous applications pending shall stand closed.
