AVA ABOUT 36 L.N.PETA TITIONER PRINCIPAL RETARIAT, N UNIT-II, KAKULAM KAKULAM RICT, A.P. ION AND APATNAM NDENT(S):

The Court made the following order:

Heard Sri Aravala Rama Rao, learned counsel for the petitioner and Sri M.Chandra Shekar, learned Assistant Government Pleader for Revenue appearing for respondents.

2. The grievance of the petitioner in the instant writ petition is against the action of the respondents in not paying the undisputed award amount of Rs.19,50,316/- in respect of the lands acquired in an extent of Ac.0.25 cents in Sy.No.16/6, Ac.0.09 cents in Sy.No.18/5A, Ac.0.11 cents in Sy.No.18/6A, Ac.0.07 cents in Sy.No.16/4B, and Ac.0.58 cents in Sy.No.18/2, total extent of Ac.1.10 cents in Mallikarjunapuram Revenue Village, L.N. Peta Mandal, Srikakulam District.

3. It is contended that the petitioner is the absolute owner of the subject property. The petitioner contends that he inherited the property and has succeeded to it by inheritance. Pursuant to the notification issued by the 2nd respondent for the acquisition of land to an extent of Ac.22.26 cents for the formation of a High Level Canal under the B.R.R.Vamsadhara Project, the subject lands were acquired. The District Collector passed a draft award in No.09/2018 dated 08.06.2018 and the same was approved by him subsequently vide proceedings dated 21.07.2018.

4. It is contended that, despite of the award being passed, no compensation has been paid. Thus, the petitioner filed the present writ petition. It is contended that the petitioner had filed a Pre-litigation case (PLC)

in PLC.No.09 of 2019 on the file of Junior Civil Judge-Cum Lok Adalat, Legal Services Authority, Amadalavalasa seeking compensation in respect of undisputed lands viz., Ac.0.25 cents in Sy.No.16/6, Ac.0.09 cents in Sy.No.18/5A, Ac.0.11 cents in Sy.No.18/6A, Ac.0.07 cents in Sy.No.16/4B, and Ac.0.58 cents in Sy.No.18/2.

5. It is contended that the 4th respondent-Tahsildar in the said PLC filed counter affidavit stating that there is no dispute with regard to the subject survey numbers. It is further stated that revised ownership certificate dated 18.11.2019 was issued for an extent of Ac.1.01 cents and the same was sent to the Land acquisition officer for further action.

6. Today, when the matter is taken up for consideration, the learned Assistant Government Pleader for Revenue appearing for the respondents has placed before the Court a copy of the written instructions received from the 4th respondent. A perusal of the same reflects as follows:

“It is submitted that as per the available record, the list of undisputed land Survey numbers i.e., 16-6, 18-5A, 18-6A, 16-4B, 18- 2, but the family members are raising objections for release of the compensation for the above-mentioned Survey numbers. That as per the available information, there is a dispute for the land covered by Sy.Nos.16/2, 16/3, 16/5 and 16/7.

It is submitted that after enquiry, the then Tahsildar, issued a revised ownership certificate vide Rc.No.151/2018 SA Dt.17.11.2019 and sent the same to the Special Deputy Collector, (Land Acquisition), Unit-II BRR Vamsadhara Project, Srikakulam.”

7. As per the above, the dispute is in respect of the Sy.Nos.16/2, 16/3, 16/5 and 16/7 and the land in the other survey numbers is undisputed. However, despite the same, the compensation amount has not been disbursed to the petitioner due to issues among the family members.

8. Having regard to the contentions advanced, this Court deems it appropriate to dispose of the Writ Petition with a direction to the respondents to release/take appropriate steps for crediting/pay the compensation amount to the petitioner as expeditiously as possible, within a period of eight (8) weeks from the date of receipt of a copy of this order, in respect of the lands in an extent of Ac.0.25 cents in Sy.No.16/6, Ac.0.09 cents in Sy.No.18/5A, Ac.0.11 cents in Sy.No.18/6A, Ac.0.07 cents in Sy.No.16/4B, and Ac.0.58 cents in Sy.No.18/2, which are undisputed even according to the respondents as stated in its counter affidavit in PLC No.09 of 2019 on the file of Junior Civil Judge-Cum Lok Adalat, Legal Services Authority, Amadalavalasa.

9. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, all pending miscellaneous applications shall stand closed.
