ORDER:
The present writ petition is filed by the petitioner-wife of the deceased employee challenging the inaction of the respondents in not releasing the retirement and pension benefits of the husband of the petitioner.
2. It is the case of the petitioner-wife that initially, the husband of the petitioner wife was appointed as driver by the 4th respondent – Corporation on 05.11.1994 on compassionate grounds. While working as driver, the husband of the petitioner died on 14.10.2021. Despite lapse of five years, the respondents are not considering and releasing the retirement benefits as well as the pension benefits to the petitioner-wife. Hence, the present writ petition.
3. The learned Government Pleader, on instructions from the 3rd respondent dated 27.02.2026 has submitted that the pensionary benefits of the petitioner are not able to process for the prolonged negligence on the part of the petitioner-wife and also lack of proper entries in the Service Register. It is further stated that immediately after receipt of the request from the petitioner herein, the respondents acted upon and steps have been taken to scrutiny the available records and also getting other service particulars from the concerned authorities.
4. Considering the submissions of both sides, without going into the merits of the case, the writ petition is disposed of directing the respondents more particularly the respondents 3 to 6 to process the papers for release of the retirement benefits and as well as pension benefits to the petitioner and see that
both the benefits are released without any further delay. It is needless to say that the entire exercise shall be completed within a period of four months from the date of receipt of copy of this order. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
