THE HON’BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY AND THE HON’BLE SRI JUSTICE TUHIN KUMAR GEDELA WRIT PETITION No.8392 of 2026

O R D E R: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy)

Heard learned counsel for the petitioner and learned Assistant Government Pleader attached to the office of the learned Advocate General appearing for the respondents.

2. This writ petition for habeas corpus is filed alleging that the daughter and son-in-law of the petitioner, by name Ediga Sravani and Gollapalli Ediga Naga Bhushana, have been illegally detained by the respondents and thereby, sought direction to the respondents to produce them before the Court and then to set them at liberty.

3. Learned Assistant Government Pleader appearing for the respondents, on instructions, submits that a case in Crime No.38 of 2026 was registered against the said two persons by name Ediga Sravani and Gollapalli Ediga Naga Bhushana in Ananthapur IV Town Police Station for the offences punishable under Sections 85, 108, 351(2) r/w 3(5) of BNS and they were arrested in connection with the said crime on 30.03.2026 and that they were produced before the concerned Magistrate on the same day and they were remanded to judicial custody. Therefore, it is denied that they were illegally detained by the respondents as alleged by the petitioner.

4. In that view of the matter, it cannot be said that the aforesaid two persons have been illegally detained or confined by the respondents. Therefore, this writ petition for habeas corpus is not maintainable.

5. Resultantly, the writ petition is dismissed. However, the petitioner and the aforesaid two persons are at liberty to move for bail in the concerned Court.

As a sequel, interlocutory applications, if any pending, in this case shall stand closed. There shall be no order as to costs.
