The Court made the following ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for the respondents.

Learned counsel for the petitioner submits that respondents issued a DKT patta vide DAR Dis.No.66/84 in favour of the petitioner’s grandfather, Neelam Narayanappa, S/o Pedda Kondappa, on 30.11.1974. Following his grandfather’s death, his grandmother executed a will on 28.10.2009 and the same was registered vide document No.12/2009 dated 12.11.2009, regarding the subject property in Sy.No.29/2 extending to Ac.4.97 cents, situated at Upparapalli Village of Siddarampuram Magera, Ananthapuramu Rural Mandal, Ananthapur District.

3. Subsequently, after the grandmother’s death, the petitioner made a representation for mutation of his name in revenue record, but the authorities failed to act, necessitating this writ petition.

4. Learned Assistant Government Pleader argues that the petitioner has not filed any application for mutation of his name in the revenue records in respect of the subject property i.e., Sy.No.29/2 to an extent of Ac.4.97 cents situated at Upparapalli Village of Siddarampuram Magera, Ananthapuramu Rural Mandal, Ananthapuramu District. Furthermore, the learned Assistant Government Pleader highlights that paragraph No.3 of the affidavit indicates the will was executed on 28.10.2009, on which same date, she passed away.

5. Learned counsel for the petitioner submits that the petitioner will file all necessary documents for mutation through proper channel and requested to dispose of the writ petition.

6. In view of the submissions of the learned counsel on both sides, this Court deems it appropriate to dispose of the matter by granting liberty to the petitioner to file an application for mutation of his name in the revenue records
