ORDER:

This writ petition is filed questioning the action of Respondents in not providing the employment to the Petitioner in place of petitioner’s father as a substitute under the displaced quota as per the guidelines issued in G.O.Ms.No.98 dated 15.04.1986 vide Memo dated 24.08.1987 as arbitrary and illegal.

2. The Petitioner’s father by name Sri Bayanaboins Suresh was possessing residential house and agricultural land at Z. Kothapalli Village, Brahmamgarimatham Mandal, Kadapa District and the said ancestral properties were acquired for Telugu Ganga Project by the Land Acquisition Authority by passing an award on 09.03.1987 and 20.03.1989. The family of the petitioner lost the only source of lively hood after the said acquisition, on meager compensation. It is submitted that the Government has notified a welfare scheme vide G.O.Ms.No.98 Irrigation (Pro Wing) Department dated 15.04.1986 for providing employment to the eligible displaced persons or their dependents in the family, but the respondents did not consider to provide the employment to the petitioner. Hence, the present writ petition.

3. Prior thereto, Government had issued G.O.Ms.No.98, Irrigation (PROJ).WING), Department dated 15.04.1986 formulating a scheme for employment to the displaced persons or their dependents against the 50% of the vacancies in the equivalent categories of Junior Assistant/Typists apart from compensation.

4. Pursuant thereto, the Petitioner submitted an application/representation dated 03.11.2025 for providing the employment to the 2nd respondent and thereafter the 2nd respondent forwarded the same to the 3rd respondent and when the petitioner approached the 3rd respondent to enquire on the same, there was no response from the 3rd respondent.

5. The Government, taking note of the delay in providing employment, had issued G.O.Ms.No.45 dated 04.07.2012, whereunder the children of the eligible displaced persons were entitled for consideration for appointment under displaced persons quota. As the representations of the Petitioner are not being considered, the present writ petition is filed.

6. Heard Sri Ganesh Santosh Reddy K, learned counsel for the Petitioner and learned Government Pleader for Services-II for the Respondents.

7. The relevant part of G.O.Ms.No.45 Irrigation & C.A.D.(PW.R&R-A2), Department dated 04.07.2012 reads as under: In the above circumstances, Government after careful examination of the matter hereby Issue orders in place of Memο.No.23152/LA.IV-R&R.II/2010-1, Dated:03-11- 2010. l.e, 'All eligible displaced persons or their spouse / son/ daughter as per the provision already available at Para (1) of G.O.Ms.No. 98, Irrigation (Project Wing) Department, dated 15.4.1986 whose applications were received within the specified time limit but could not be provided employment so far due to administrative reasons may be considered for employment as per seniority subject to fulfilling all other eligibility criteria prescribed for that category of job. This benefit shall not be extended to those displaced families who have already got employment under this scheme" as per various G.Os.

8. In the light of the above, the Petitioner is entitled to be considered for employment in place of his father, who is included among the list of eligible persons as per the list prepared by the Special Deputy Collector dated 24.01.2011.

9. The writ petition is therefore disposed of with the following direction:

(i) The Respondents are directed to consider the representations of the Petitioner in light of para 4 of G.O.Ms.No.45 dated 04.07.2012 and pass appropriate orders within a period of eight (8) weeks from the date of receipt of a copy of this order.

(ii)

(ii) No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
