ORDER:
The instant petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking to grant anticipatory bail to the
Petitioners / Accused Nos.1, 2, 3, 5 and 17, in connection with Crime No.1 of 2026 on the file of Yellanuru Police Station, Ananthapuramu District which is registered for the offences under Sections 191(2), 191(3), 109(1) and 118(1) read with 190 of the Bharatiya Nyaya Sanhita, 2023.
2. Sri V.Lokabiram, learned counsel for the Petitioners would submit that the statements of the witnesses disclose that there is no usage of deadly weapons and iron rods as alleged by the De facto complainant and sticks and stones were only used by the Accused. It is further submitted that, Accused Nos.6, 14 and 18 in the present crime were already released on bail. Learned counsel would further submit that, most of the investigation is completed. It is further submitted that the Petitioners are agriculturists and are ready to furnish sureties to the satisfaction of the Court.
3. Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor vehemently opposed the petition and would submit that there are specific allegations against the Petitioners with regard to the commission of the alleged offences. It is further submitted that no case is made out to grant anticipatory bail to the Petitioners at this stage.
4. Having regard to the submissions made and on perusal of the material available on record, this Court finds that there are prima facie allegations against the Petitioners regarding their involvement in the commission of the offences. The nature and gravity of the accusations, coupled with the stage of the investigation, do not warrant the exercise of discretion in favour of the Petitioners. The mere fact that some of the co- accused have been granted bail or that certain weapons were allegedly not used, by itself, cannot be a ground to extend the relief of anticipatory bail to the Petitioners, in the presence of prima facie material.
5. In the result, the Criminal Petition is dismissed. The Petitioners are at liberty to surrender before the concerned Court and move regular bail application. On filing such application, the learned Judge may pass appropriate orders according to law.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
