...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction, more particularly a Writ of Mandamus, declaring the high-handed action of the respondents in continuing the remarks 'marking the subject land of the petitioner to an extent of Acs.5-79 cents, covered by Sy.No.107/1 of Koyyuru Village, Bapulapadu Mandal,

Krishna District, as LC (Land Ceiling) in Field Measurement Book (FMB), as illegal, arbitrary, biased, unconstitutional and against the judgment dated 06.03.1978 in Appeal and the common judgment dated 29.03.1980 in LRA.Nos.18 and 19 of 1980 passed by the Land Reforms Appellate Tribunal (LRAT), Krishna at Machilipatnam, and consequently, direct the respondents to remove the remarks 'marking the above land as LC (Land Ceiling) in Field Measurement Book (FMB) and update the Revenue records, and pass IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner over the subject land to an extent of Acs.5-79 cents, covered by Sy.No.107/1 of Koyyuru Village, Bapulapadu Mandal, Krishna District, on the ground that in the remarks it is marked as LC (Land Ceiling) in Field Measurement Book (FMB), pending disposal of the above writ petition and pass Counsel for the Petitioner:

1. D S N V PRASAD BABU Counsel for the Respondent(S):

1. GP FOR REVENUE The Court made the following Order:

Heard Sri D.S.N.V. Prasad Babu, learned counsel for the petitioner and the learned Assistant Government for Revenue appearing for the respondents.

2. The grievance of the petitioner in the instant Writ Petition is against the action of the respondents in continuing the subject land of the petitioner over an extent of Ac.5.79 cents in Sy.No.107/1 of Koyyuru Village, Bapulapadu Mandal, Krishna District, as LC (Land Ceiling) in the Field Measurement Book (FMB), despite the Judgment of the Land Reforms Tribunal Appellate

Tribunal, Machilipatnam in LRA.Nos.18 and 19 of 1980, and consequently sought a direction to the respondents to remove the said marking in the Field Measurement Book (FMB).

3. When the matter has been taken up for consideration today, the learned Assistant Government Pleader for Revenue has placed before the Court a copy of instructions received by him in the case from the respondent No.4 – Tahsildar. A perusal of the same would reflect that a comprehensive resurvey was conducted in the village, and in the said survey, RS.No.107/1 has been denoted as LP.No.644, and a new LP map has been generated in respect of the said land, and in the said process, the remark LC does not reflect in the relevant remarks column/LP Map. It is further stated that by operation of the resurvey process, all old sketches (including the FMB mentioned by the petitioner) are deemed to be “inexistence” and superseded by the new LP maps. Since the new records do not contain the marking as „LC land‟, the grievance of the petitioner that the land is treated as Ceiling land no longer merits consideration.

4. The said instructions of the respondent No.4 – Tahsildar are placed on record.

5. In the light of the said submission, the grievance of the petitioner is resolved and no further orders are required to be passed in the present Writ Petition.

6. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, all pending miscellaneous applications shall stand closed. ______________________________ JUSTICE KIRANMAYEE MANDAVA Dated: 24.03.2026 MSI
