ORDER:

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita,

(for brevity, “BNSS”) by the petitioner/Accused seeking grant of pre-arrest bail in connection with Crime No. 12 of 2026 of Dargamitta Police Station, Nellore District.

2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor for the State.

3. During the course of hearing, it is brought to the notice of this Court that the present petition has been filed directly before this Court. The learned counsel for the petitioner submits that the petitioner has already filed a quash petition, which is pending consideration before another Bench of this Court. It is further submitted that liberty may be granted to the petitioner to file a fresh petition before the appropriate Court, and in the meantime, protection may be granted.

4. The learned Assistant Public Prosecutor submits that this Court may pass appropriate orders.

5. Considering the submissions made and in view of the fact that the petition has been filed directly before this Court, the learned counsel for the petitioner is permitted to withdraw the present petition with liberty to file a fresh petition before the competent District Court. The District Court is directed to consider and dispose of such application, if filed, on its own merits, without being influenced by any observations made by this Court in the present order. The respondent/State is directed not to take any coercive steps against the petitioner for a period of two (2) weeks from the date of this order. Within the said period, the petitioner is at liberty to approach the District Court.

6. In that view, the Criminal Petition is dismissed as withdrawn. There shall be no order as to costs.

Consequently, miscellaneous petitions pending if any, shall stand closed. ___________________________________
