1. THE ADVOCATE GENERAL The Court made the following:

THE HON’BLE SRI JUSTICE CHEEKATI MANAVENDRANATH ROY AND THE HON’BLE SRI JUSTICE TUHIN KUMAR GEDELA WRIT PETITION No.7733 of 2026

O R D E R: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy)

Heard learned counsel for the petitioner and learned Assistant Government Pleader attached to the office of the learned Advocate General appearing for the respondents.

2. This writ petition for habeas corpus is filed seeking direction to the respondent police officials to produce the husband of the petitioner, by name Peetla Sriramulu (hereinafter referred to as ‘corpus’), who is alleged to have been illegally confined by the respondent police officials, before the Court and then to set him at liberty.

3. When the matter is taken up for hearing, learned counsel for the petitioner submits that the corpus was summoned to the police station by the 3rd respondent - Station House Officer of Atmakur Police Station on 16.03.2026 and thereafter, he was sent back and he was again asked to come to the police station on 18.03.2026 for enquiry and accordingly, he attended the enquiry and after enquiry, he was let off. It is stated that as on today, the corpus is at liberty and he is not in confinement or detention of the police.

4. Learned Assistant Government Pleader appearing for the respondents also submits, on instructions, that a crime was registered against the corpus in Atmakur Police Station and a notice under

Section 35(3) of BNSS was served on him and he attended the police station in response to the said notice and after enquiry, he was let off.

5. In view of the above submissions, when admittedly there is no illegal confinement or detention of the corpus by the police, this writ petition for habeas corpus is not maintainable.

6. Accordingly, the writ petition is dismissed. However, as it is stated that a crime was registered against the corpus, the law has to take its own course.

As a sequel, interlocutory applications, if any pending, in this case shall stand closed. There shall be no order as to costs.
