ORDER:

The instant petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking to grant anticipatory bail to the Petitioner / Accused No.15, in connection with Crime No.277 of 2024 on the file of Etcherla Police Station, Srikakulam District which was registered for the offence under Section 109 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023.

2. Heard Sri P.Nagendra Reddy, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Asst.Public Prosecutor for State/Respondent.

3. Learned counsel for the Petitioner would submit that the allegations leveled against the Petitioner are false and he was falsely implicated in the present case. Learned counsel for the Petitioner would submit that the Petitioner was not present at the relevant time and place. Petitioner is ready to furnish sufficient sureties to the satisfaction of the Court.

4. Learned Assistant Public Prosecutor vehemently opposed the petition and would submit that there are specific allegations against the Petitioner and no case is made out to grant anticipatory bail to the Petitioner.

5. Considering the submissions made and on a perusal of the material on record, this Court is of the view that, prima facie, there are specific allegations against the Petitioner in the present case. At this stage of investigation, this Court is not inclined to grant the discretionary relief of anticipatory bail to the Petitioner.

6. Accordingly, the Criminal Petition is dismissed. However, the Petitioner is at liberty to surrender before the Court concerned within one week from the date of receipt of copy of this Order and move a regular bail application. On filing such application, the learned Judge may pass appropriate orders according to law as expeditiously as possible.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
