ORDER:

The present writ petition is filed seeking the following relief: “….to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the acts on the part of the respondents 2 to 4 in seeking to demote the petitioner from Senior Assistant to Junior Assistant without notice and without calling her objections by preparing provisional seniority list amounts to amounts to erroneous, arbitrary, besides being violative of principles of natural justice and Articles 14, 29, 21 and 311 of Constitution of India and consequently direct the respondents to continue the petitioner as a Senior assistant SRO, Chittoor as usual and to pass….”

2. Heard Smt. Kavitha Gottipati, learned counsel for the petitioner, learned Government Pleader appearing for respondents.

3. Learned counsel for the petitioner submitted that the petitioner was appointed as Junior Assistant in Stamps and Registration Department on 15.6.2013. Subsequently, the petitioner was promoted to the post of Senior Assistant for the panel year prepared in 2021 and accordingly promoted on 28.01.2021 to the post of Senior Assistant and posted at Sub-Registrar Office, Chittoor. Considering the submissions, this Court has passed interim directions on 11.8.2023 which are as follows: …In view of the same, there shall be an interim direction to the respondents for a period of four (4) weeks, to continue the petitioner as Senior Assistant, SRO, Chittoor….”

4. Subsequent to the above said orders, the petitioner has continued as Senior Assistant. Aggrieved by the said interim orders, one N.Revathi, working as Junior Assistant in District Registrar Office, filed implead application in I.A.No.01 of 2025 stating that the case of the implead petitioner was differed for the reason of pending disciplinary proceedings and subsequently the Government vide G.O.Rt.No.664 dated 23.9.2024 dropped the charges against the petitioner and directed respondent no.2 to take further action in the matter. When the same was not implemented, the implead petitioner has approached this Court by filing the Writ Petition No.3351 of 2025. Consequent to the disposal of the writ petition, the implead petitioner herein has also pressed the provisions of Contempt Case. In the said circumstances, contemplating that the implead petitioner was senior and her case has been differed only on the ground of pendency of departmental proceedings, as the respondents have already dropped proceedings against the implead petitioner for effecting promotion and for want of vacancy, the respondents may revert the petitioner, apprehending the same, the present Writ Petition is filed.

5. Considering the entire issue, as of now, the respondents have not initiated any action. Only they have considered the case of the implead petitioner for dropping the charges, if at all if they want to effect the promotions based on seniority, the respondents are directed to issue notice to all the concerned including the petitioner and after providing an opportunity based on the seniority, the respondents may take appropriate action. This Court is of the view that the present Writ Petition is only based on apprehension and there is nothing to decide in this matter.

6. With the above observations, the Writ Petition is disposed of. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
