ORDER:
This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the Petitioner seeking to modify the conditions imposed in order dated 29.01.2026 in Crl.M.P.No.115 of 2026 on the file of the learned Special Judge for Trial of offences under NDPS Act-cum-I Additional District and Sessions Judge, Srikakulam.
2. Heard Sri Ramineni Sudheer, learned counsel for the petitioner/accused and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.
3. Learned counsel for the petitioner would submit that the petitioner herein is Accused No.1 in Crime No.389 of 2025 of Kasibugga Police Station, registered for the offences punishable under Sections 20(b)(ii)(B) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. Learned counsel would further submit that the petitioner/Accused No.1 filed Crl.M.P. No.115 of 2026 before the learned Special Judge for Trial of Offences under NDPS Act-cum-I Additional District and Sessions Judge, Srikakulam, seeking bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The learned Judge was pleased to allow the said bail application subject to certain conditions. However, it is submitted that the petitioner is an illiterate person and the sole breadwinner of his family, earning his livelihood through coolie work. Though bail was granted, the learned Judge imposed a condition directing the petitioner to execute a personal bond for Rs.25,000/- with two sureties for a like sum each to the satisfaction of the Court. It is contended that the petitioner is unable to comply with the said condition due to his poor financial condition. Therefore, the learned counsel prays that this Court may be pleased to modify the conditions imposed by the learned Bail Court.
4. Learned Assistant Public Prosecutor on behalf of the State would submit that the Court may pass appropriate orders.
5. Considering the submissions made, this Criminal Petition is disposed of. The condition imposed by the learned Judge in Crl.M.P. No.115 of 2026 is modified in the following terms: “The petitioner shall be released on bail on executing a personal bond for Rs.25,000/- and furnishing two cash sureties in the form of fixed deposits, each worth Rs.25,000/- to the satisfaction of the learned Special Judge for Trial of Offences under NDPS Act-cum-I Additional District and Sessions Judge, Srikakulam.”
6. The rest of the conditions imposed by the learned Special Judge for Trial of Offences under NDPS Act-cum-I Additional District and Sessions Judge, Srikakulam, shall remain unaltered.
As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed. __________________________________________ DR. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 13.03.2026. UPS
