IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI

Writ Petition No: 6882 of 2026 along with Writ Petition No.6150 of 2026 Bench Sr.Nos:- 8 & 54

Writ Petition No: 6882 of 2026 Nimra Institute of Medical Sciences (NIMS)

CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R. RAGHUNANDAN RAO DATE : 12th March, 2026. P C :

In the present set of writ petitions, the petitioners seek a direction in the nature of Mandamus directing the official respondents to conduct a special stray vacancy round under the Convenor/Competent Authority Quota and Management Quota, despite the fact that the last date of joining expired on 28.02.2026.

HCJ & RRRJ WP_6882_2026

2. In W.P.Nos.5736 and 5409 of 2026, dated 26.02.2026, filed by candidates seeking similar relief, the prayer made was rejected and the petitions dismissed as being without merit.

3. In the aforementioned common judgment and order, this Court had held that since the process of selection was required to be completed in terms of the various pronouncements of the Apex Court as well as the regulations of the MCC, no interference was warranted in the facts and circumstances of the case.

4. We cannot take a divergent view in the present cases merely because, instead of a candidate, it is the College or the Colleges Managements Association that seeks extension of time and a direction to conduct a special stray vacancy round.

5. Learned counsel for the NMC states that the question of conducting a special stray vacancy round has to be considered and decided only by the MCC, and once that decision is taken, it has then to seek approval from the Apex Court, as has been the practice in the past.

6. Be that as it may, we do not find any merit in the present writ petitions. However, the petitioners are at liberty to approach the MCC for appropriate orders, which may consider the request, if a representation is filed, or has already been filed, in that regard, strictly in accordance with the Rules governing the subject.

HCJ & RRRJ WP_6882_2026

The Writ Petitions shall stand disposed of. No costs. Pending miscellaneous applications, if any, in these cases, shall stand closed.
