ORDER:-

The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the Petitioner/Accused No.2 for grant of anticipatory bail in connection with Crime No.184 of 2024 of Tangutur Police Station, Prakasam District, registered for the offences punishable under Sections 8(c) read with 22(b) NDPSA.

2. Case of the prosecution, in brief, is that on 02.09.2024, on receipt of credible information regarding illegal possession and transportation of Methamphetamine drug, the Inspector of Police of S.Konda Police Station along with his staff and mediators, proceeded to Chennai to Ongole road, near Tangutur Village. During vehicle checking, A1 was found in possession of 39 grams of Methamphetamine. On enquiry, A1 stated that, at the instance of A2, he went to Bangalore and was transporting it to Guntur for Rs.10,000/- and also received 2grams for himself. The contraband along with other material was seized under the cover of mediators report.

3. Heard learned counsel for the Petitioner and the learned Assistant Public Prosecutor representing the Respondent-State. Perused the material on record.

4. Learned counsel for the Petitioner would submit that the petitioner has been falsely implicated in the present crime solely on the basis of confessional statement made by A1. Learned counsel would further submit that the petitioner is innocent and, he is ready to furnish sureties to the satisfaction of the Court. Learned counsel finally prays to allow the petition.

5. Per contra, learned Assistant Public Prosecutor would submit that A1 was found in possession of 39 grams of Methamphetamine and basing on his confessional statement, the name of the petitioner herein/A2 is figured in the present crime. Though a confession is generally inadmissible, it is admissible to the extent it leads to discovery of material objects. It is further submits that custodial interrogation is required in this matter and the investigation is at a nascent stage and therefore, the petitioner herein does not deserve for anticipatory bail and hence, prays for dismissal of the petition.

6. A perusal of the material on record shows that, based on the confessional statement of A1, the name of the petitioner/A2 has been figured in the present crime. The statement of A1 discloses that, on the instructions of A2, A1 used to go to Bangalore to collect Methamphetamine from a location specified by A2, and transport the same to Guntur for sale to students. As per the prosecution, the source of the drug has to be ascertained from the petitioner, and therefore, custodial interrogation of the petitioner is very much necessary.

7. In view of the aforesaid facts and circumstance of the case, it is not a fit case for grant of anticipatory bail to the petitioner.

8. Accordingly, the Criminal Petition is dismissed.

As a sequel, miscellaneous applications pending, if any, shall stand closed. ___________________________________
