ORDER

1. This contempt case is filed against the respondents for willful disobedience of the Interim order dated 07.12.2022 passed by this Court in I.A.No.1 of 2022 in W.P.No.38457 of 2022.

2. It is contended that, despite the suspension of the endorsement in R.C.No.31/2022 dated 07.07.2022, respondent No.3 (contemnor No.3) collected tax from respondent No.4 in the writ petition on 23.01.2024, which is willful disobedience and violation of the orders passed by this Court.

3. However, the learned counsel appearing for contemnor No.3, upon producing the original records, submitted that the tax amount was collected by the Bill Collector without the knowledge of contemnor No.3, and that upon noticing the same, the receipt was taken back and the amount was refunded to respondent No.4, with further directions to all employees, not to collect any tax from either party until disposal of the main writ petition.

4. Considering the said submission, this Court believes that the collection of tax, by the Bill Collector was without the knowledge of contemnor No.3 and is therefore, there is no willful disobedience of the orders of this Court.

5. Recording the said submission, the Contempt Case is closed. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall also stand closed. ___________________ JUSTICE D.RAMESH Date :12.03.2026 JLSR
