ORDER:

This Criminal Petition is filed seeking cancellation of the pre-arrest bail granted to the respondent/Accused No.25 vide order dated 10.06.2024 in Crl.M.P.No.229 of 2024 passed by the learned X Additional Sessions Judge, at Guruzala, in connection with Crime No.59 of 2024 of Karampudi P.S., Palnadu District.

2. Heard Sri Neelothpal Ganji, learned Assistant Public Prosecutor representing on behalf of the State/petitioner and Ms. Aishwarya Nagula, learned counsel for the respondent/accused. Perused the record.

3. As can be seen from the record, it is not the case that the respondent/accused has violated the conditions of bail imposed while granting anticipatory bail to him. But the order is not sustainable inasmuch as no conditions were imposed while granting anticipatory bail on the premise that there is life a threat to the respondent/accused. However, it is also not in dispute that the respondent/accused has not been cooperating with the investigation after his release. It is also represented that the respondent/accused is in judicial custody relating to other crimes.

4. Considering the submissions made and upon perusal of the material on record, since this Court does not find any reason to interfere with the judicial discretion exercised by the learned X Additional Sessions Judge, at Guruzala, in granting anticipatory bail to the respondent/accused No. 25, it is apposite to dispose of the present petition by imposing the following conditions: i. The Petitioner/Accused No.25 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the Investigating Officer as and when required. ii. The Petitioner/Accused No.25 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. iii. The Petitioner/Accused No.25 shall surrender his passport, if any, to the concerned Court. If he claims that he does not have a passport, he shall submit an affidavit to that effect to the concerned Court. iv. The Petitioner/Accused No.25 shall not leave the counter without the permission of the concerned Court.

5. Accordingly, the Criminal Petition is disposed of.

Consequently, miscellaneous applications pending, if any, shall stand closed. __________________________________________ DR. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 12.03.2026. UPS
