ORDER:

The present writ petition is filed seeking the following relief: “….to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring in action of 3rd respondent in paying arrears of family pension for the period from the month of January 2020 to September 2022 as illegal, arbitrary, whimsical and capricious resulting in violation of Article 14,21 and 300A in of the Constitution of India and consequently direct the respondent No. 2 and 3 to tender the payment of arrears of family pension forthwith, which remained unpaid for the period from January 2020 to September 2022 with interest @12 percent and pass such…..”

2. Heard Mr. Karanam Ramesh, learned counsel for the petitioner and learned Government Pleader for services-I appearing for the respondents.

3. The contention of the petitioner is that pursuant to G.O.Ms.No.152 dated 25.11.2019, the respondents have stopped payment of pension from January 2020 onwards. The said G.O is challenged by some of the aggrieved persons by way of Writ Petitions vide W.P.No.19671 of 2020 and batch and the said batch was disposed of by this Court vide order 05.3.2021 by setting aside the said Government Order and also directed to release the arrears of pension with 6% interest. Despite the said directions, the respondents have not released the arrears of pension except restoring the pension w.e.f. October 2022 for which the petitioner has moved a representation by way of a legal notice dated 22.8.2025. Even after receipt of the said notice, the respondents have not acted upon the same. Hence the Writ Petition.

4. Learned standing counsel appearing on behalf of the APEPDCL, on instructions, has submitted that the matter has been referred to the respondent no.2 and they are awaiting the orders from respondent no.2.

5. Considering the said submissions, the Writ Petition is disposed of directing respondent no.2 to consider the recommendations/ proposals sent by respondent no.3 and take appropriate decision based on the orders passed by this Court in the batch of Writ Petitions with regard to release of arrears of pension to the petitioner. It is needless to say that the said exercise shall be completed within two

(02) months from the date of receipt of a copy of the order. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _______________________ JUSTICE D.RAMESH
