ORDER:
This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita,
(for brevity <BNSS=) by the petitioner/Accused seeking grant of pre-arrest bail in connection with Crime No. 195/2022, dated on the file of PS Sarpavaram, East Godavari District, registered for the offences punishable under Sections 302, 201 of Indian Penal Code (for short <IPC=) and Sections 3(1)(r)(s) & 3(2)(v) of the SC’s and ST’s (POA) Act, 1989.
2. When the matter is taken up for hearing, Sri C.Raghu, learned Senior Counsel assisted by Sri G.Sai Lochan, learned counsel for the petitioner/accused would submit that the Court may pass appropriate orders, as the Trial Court has already taken cognizance against the petitioner for offences punishable under the provisions of the SCs and STs (POA) Act, 1989. Therefore, anticipatory bail is not maintainable.
3. Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor would submit that the investigating agency has filed a report against the petitioner for offences punishable under Sections 302 and 201 of the IPC and Sections 3(1)(r), 3(1)(s), and 3(2)(v) of the SCs and STs (POA) Act, 1989. The Court has taken cognizance and issued a warrant. She further submitted that the Court may pass appropriate orders, as the petition seeking anticipatory bail is not maintainable.
4. Sri Posani Akash, learned counsel for the respondent No.2 is in attendance.
5. In the light of the submissions made, the Criminal Petition is dismissed since relief has become infructuous, as anticipatory bail is not maintainable when the Court has taken cognizance for the offences under the provisions of the SC’s and ST’s (POA) Act, 1989.
As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
