ORDER:

This Criminal Petition under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), has been filed by the Petitioners / Accused Nos.1 and 3, seeking regular bail in connection with Crime No.462 of 2021 on the file of Gajuwaka Police Station, Visakhapatnam registered for the offence under Section 307 read with 34 of IPC.

2. Heard Ms.Bandi Praveena, learned counsel for the Petitioners and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing the Respondent/State.

3. Learned counsel for the Petitioners submits that the Petitioners are innocent of the alleged offence and they are falsely implicated in the present case. Learned counsel would further submit that the Petitioners have been in judicial custody since 06.03.2025 and that they were produced before the Court on execution of P.T warrants. It is further submitted that the crime is of the year 2021.

4. Learned Assistant Public Prosecutor opposed the petition and would submit that there are specific allegations against the Petitioners. It is further submitted that the Petitioners involved in several cases and they are habitual offenders. Hence, prayed for dismissal of the petition.

5. Having considered the rival submissions and upon perusal of the material available on record, this Court finds that there are specific allegations against the Petitioners in connection with the alleged offence. The contention of the Petitioners that they are innocent and falsely implicated cannot be examined at this stage. Further, the Petitioners involved in several other cases and they are produced before the Court on execution of P.T warrant. The mere fact that the crime is of the year 2021 by itself is not a sufficient ground to enlarge the Petitioners on bail.

6. In the result, the Criminal Petition is dismissed. However, learned trial Judge is directed to dispose of the matter according to law as expeditiously

as possible, since the Petitioners are in jail for the last one year and report the progress of the case to the Registrar(Judicial) by 01.04.2026.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
