ORDER :

The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity „the BNSS‟) by the Petitioner/Accused No.14 for granting of pre-arrest bail in connection with Cr.No.470 of 2024 dated 25.09.2024 on the file of Tirupathi East Police Station, registered for the alleged offence punishable under Section 274, 275, 316(5), 318(3), 318(4), 61(2), 299 r/w 49 r/w 3(5) of the Bharatiya Nyaya Sanhitha (for short “BNS”) and Section 51, 59 of Food Safety and Standards Act.

2. When the matter was taken up for hearing, Sri P.S.P. Suresh Kumar, learned Special Public Prosecutor for CBI, brought to the notice of this Court that the petitioner/accused, who is an employee of M/s. Bhole Baba Dairy, has cooperated with the investigation and has also given a statement under Section 183(1) of BNSS before the learned Magistrate, Tirupati. It is further submitted that he has filed a petition, before the learned ACB Court, Nellore to make the petitioner as “approver”, which is pending for consideration. The learned Special Public Prosecutor also submitted that charge sheet has been filed in the matter and is pending before the Court for consideration. In view of the above facts and circumstances, it is contended that there is no threat of arrest against the petitioner/accused.

3. Sri Thathireddy Ashok Srivastava, learned counsel for the petitioner would submit that recording the submissions made by the learned Special Public Prosecutor, the petition may be disposed of.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. ___________________________________
