2. GP FOR COMMERCIAL TAX

The Court made the following Order: (per Hon’ble Sri Justice R. Raghunandan Rao)

The petitioner herein, being aggrieved by the order of the Appellate Deputy Commissioner, dated 27.04.2006, preferred an Appeal before the Sales Tax Appellate Tribunal. During the pendency of this Appeal, the petitioner sought stay of collection of tax, by filing an application, before the Joint Commissioner (legal). However, the 1st respondent – Assessing Officer, had issued an order of attachment of the bank account of the petitioner, on 28.07.2006. Aggrieved by the said order, the petitioner had moved this Court, by way of W.P.No.15911 of 2006, which came to be disposed of, on 03.08.2006, by revoking the attachment or condition of the petitioner giving immovable property as security to the satisfaction of the 1st respondent. Even while these proceedings were pending, another distraint order in Form - 1, was issued by the 2nd respondent against which the present Writ Petition has been filed.

2. It appears that, during the pendency of this Writ Petition, T.A.No.141 of 2007, filed before the Sales Tax Appellate Tribunal, has been allowed in favour of the petitioner, by way of an Order, dated 27.07.2009.

3. In those circumstances, nothing further survives in this Writ Petition and accordingly, it is closed.

There shall be no order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
