ORDER:

This Contempt Case is filed against the respondent complaining wilful disobedience of the interim order, dated 11.10.2022 in I.A.No.1 of 2022 passed in W.P.No.33205 of 2022.

2. At the stage of admission of the Writ Petition, this Court, by its order, dated 11.10.2022 granted interim stay of all further proceedings in Ref.No.SAG/3/2022, dated 04.10.2022 issued by the Panchayath Secretary, S.Agraharam Village, Routhalapudi Mandal, East Godavari District, pending disposal of the Writ Petition.

3. During the course of hearing of this case today, learned counsel for the respondent, on instructions, would submit that on behalf of the respondent, a counter affidavit has been filed. At paragraph No.5 of the said counter affidavit, it is averred that, he never interfered with the subject property nor issued any proceedings to demolish the house of the petitioners. After passing of the interim order, the petitioners have approached the gram panchayath seeking permission for raising new thatched leaves for their house. He further stated that he never taken any steps to dispossess the petitioners.

4. Learned counsel for the respondent would submit that the possession of the petitioners is never disturbed by the respondent.

5. Learned counsel for the petitioners also endorsed the same and would submit that at present, the respondent is not interfering into the possession of the petitioner and this contempt case can be closed.

6. In view of the above factual position, in our considered view, further adjudication is not required in this contempt case.

7. Accordingly, the Contempt Case is closed. No order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the Contempt Case shall stand closed.
