ORDER :

The Criminal Petition has been filed under Section 482of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.3 & 5 in the event of their arrest in connection with Crime No.156 of 2025 of Attili Police Station, West Godavari District, for the offences punishable under Sections115(2), 109(1), 351(2) r/w 3(5) of B.N.S Act.

2. Heard Mr.K.L.N.Swamy, learned counsel for the petitioners and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing the State/respondent. Perused the record.

3. The case of the prosecution in brief, is that, on 21.12.2025 at about 2.30 P.M., the complainant lodged a report stating that he had previous drainage disputes with his neighbour. On the same day at about 08.30 A.M., when the complainant’s brother’s son was going to the Panchayat tap for water, A-3 abused and attacked him. Thereafter, A1 and A2 threw chilli powder into his eyes, while A2 attacked him with a knife and A1 with a crowbar, causing injuries to his right hand. On raising cries, he ran towards his house. Subsequently, A1 to A3 along with A4 to A8 and others came to the complainant’s house armed with knives, crowbars, rods and sticks, broke the back side door, damaged laptops, broke the iron safe, destroyed household articles worth about Rs.50,000/-, beat the complainant and his family members, and damaged his Royal Enfield Motorcycle. Neighbours rushed to the spot and shifted the injured to Government Hospital, Tanuku, in a 108 ambulance for treatment.

4. Learned counsel for the petitioner would submit that the petitioners herein are the accused Nos.3 and 5. He would further submits that there are no specific overt-acts attributed against the petitioners. He would further submits that the learned IV Additional District and Sessions Judge, West Godavari at Tanuku dismissed the earlier anticipatory bail application in Crl.MP.No.33 of 2026 vide Order dated 11.02.2026. It is further submits that, the petitioners are ready and willing to furnish sufficient sureties to the satisfaction of the Court to secure their presence for the purpose of investigation.

5. Learned Assistant Public Prosecutor vehemently opposed the petition and would submit that the investigation is not yet completed. He would further submit that there is no change of circumstances, from the date of dismissal of the earlier bail application. If the petitioners are enlarged on anticipatory bail, there is every likelihood of threatening of witnesses of prosecution and tampering of evidence of prosecution. Hence, she finally prays for dismissal of the petition.

6. Considering the submissions of both sides and upon perusal of the material on record, and in the light of the nature and gravity of the allegations levelled against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners at this stage.

7. Accordingly, the Criminal Petition is dismissed. However, the petitioners/accused Nos.3 and 5 are at liberty to surrender before the learned Jurisdictional Court within a period of one (01) week from the date of receipt of copy of this order, and move an appropriate application before the learned Jurisdictional Court. The learned Jurisdictional Court is directed to dispose of the said application in accordance with law, on its own merits by giving due and sufficient opportunity to the learned Public Prosecutor concerned, and pass appropriate orders as expeditiously as possible.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. ___________________________________
