ORDER:-

The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1 to 3 for granting of pre-arrest bail in connection with Crime No.110 of 2025 of Puttaparthi Town Police Station, Sri Sathya Sai District, registered for the alleged offence punishable under Sections 118(1), 126(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’).

2. The case of the prosecution, in brief, is that on 31.10.2025 at about 3.30 p.m., in front of the house of the complainant situated at Vivekananda Road, Vinayaka-2 Apartment, Puttaparthy, the accused No.1 came from Bangalore in his car bearing No. KA-01-NC-6905 and stopped it across the house of the complainant while the complainant and his wife came on a bike. At that time, the complainant questioned accused No.1 as to why he had parked his car across the way leading to his house. On that, accused No.1, along with his father (accused No.2) and his mother (accused No.3), wrongfully restrained the complainant, picked up a quarrel, beat him with a stick and caused bleeding injuries. Meanwhile, the neighbours intervened and pacified the quarrel.

3. Heard P.Narahari Babu, learned counsel for the petitioners and Mr.K.Sandeep, learned Assistant Public Prosecutor.

4. The learned counsel for the petitioners/accused Nos.1 to 3 would submit that initially a notice under Section 35(3) of BNS was served on the petitioners and a case was registered for the offences under Sections 118(1), 126(2) read with 3(5) of BNS. Now the petitioners apprehend arrest in this matter and therefore urge this Court to grant pre-arrest bail to them.

5. The learned Assistant Public Prosecutor would submit that the defacto complainant suffered grievous injuries and therefore the police have filed a petition before the Court below seeking addition of Section 118(2) of BNS, and the Court may pass appropriate orders.

6. Considering the submissions made and on perusal of the material on record, it is seen that the petitioners were served with notice under Section 35(3) of BNS and thereafter, since the victim suffered grievous injuries, the section of law was altered. The learned Assistant Public Prosecutor submits that the police cannot arrest the petitioners without obtaining permission from the Court when they have already been served with notice under Section 35(3) of BNS. The learned counsel for the petitioners submits that, by recording the submission of the learned Assistant Public Prosecutor, the petition may be disposed of.

7. In the light of the submissions made, the criminal petition is disposed of, however with an observation that the police shall not arrest the petitioners without obtaining permission from the concerned Court.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
