ORDER:-

The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.519 of 2025 of Tiruchanur Police Station, Tirupati District, registered against the Petitioner/Accused No.1 herein for the offences punishable under Section 109(1) r/w 3(5) of BNS.

2. The case of the prosecution is that on 24.12.2025 at 5.00 p.m., at PCR Wines, on Tirupati-Renigunta Road, Near Padmavathi Puram, Tirupati, the injured V.Raghunadha Reddy, aged about 62 years being the father of the defacto complainant, who is having habit of consuming liquor, went to PCR Wines near Padmavathi Puram along with his friend Ramesh and while they were consuming liquor, simultaneously the accused who were at PCR Wines consuming liquor, picked up quarrel with the injured Raghunath Reddy by demanding money for liquor, for which, he refused to give the money to the accused persons, at that some wordy quarrel arose between the injured and the accused persons. Then the accused assaulted and beat the injured indiscriminately, and when one Ramesh and others intervened to separate them, in all of sudden one of the accused who carried knife with him with an intention to kill the injured, stabbed him on his stomach, in the meantime the cashier and other workers in the shop rushed to the scene and on seeing them, the accused persons fled away from the spot and immediately the injured was shifted to Maruthi Hospital, Tirupati and got admitted for treatment.

3. Heard Mr.Nuthalapati Krishna Murthy, learned counsel for the petitioner and Mr.K.Sandeep, learned Assistant Public Prosecutor representing the respondent/State. Perused the record.

4. The learned counsel for the petitioner would submit that the petitioner was falsely implicated in this case and the petitioner have not committed any offence as alleged by the prosecution. The petitioner is the sole breadwinner of his family. The petitioner undertakes to abide by any condition that this Court may impose while granting bail to the petitioner.

5. The learned Assistant Public Prosecutor, strenuously opposed the grant of bail, contending that the investigation is still underway and several material witnesses are yet to be examined. It is submitted that enlargement of the petitioner on bail at this stage would seriously hamper the progress of the investigation and may result in non-cooperation from the petitioner. The injured person is discharged from the hospital. The prosecution further apprehends that the petitioner, if released, may influence the witnesses, thereby obstructing the course of investigation. It is also urged that there exists a real and imminent risk of the petitioner absconding and evading the due process of law and it is urged to dismiss the bail petition.

6. On perusal of the record and the statements of witnesses, it appears to be there are serious allegations against the petitioner/Accused No.1, who is alleged to have beat the injured indiscriminately and intention to kill the injured, stabbed him on his stomach. The investigation is at a nascent stage, and some more material witnesses are yet to be examined. The petitioner was arrested on 03.01.2026. He has been in judicial custody for the past 62 days. The investigation further reveals that the petitioner played a pivotal role along with Accused No. 2 in beat the injured indiscriminately and intention to kill the injured, stabbed on his stomach. There are no merits in the petition. Hence, the criminal petition is dismissed.

7. In the result, the Criminal Petition is dismissed.

As a sequel thereto, the miscellaneous petitions pending, if any, shall stand closed.
