SURYA HNA DIST., PENAMALURU ...PETITIONER OF ANDHRA AN/MANAGING TION CIRCLE, OF ANDHRA ND MANDAL, TION CIRCLE, OF ANDHRA ND MANDAL. TS DISTRICT M STRICT, - SPONDENT(S):

Counsel for the Petitioner:

1. Mr.SITA RAM CHAPARLA Counsel for the Respondent(S):

1. V V SATISH (SC for APEPDCL)

The Court made the following order:

The writ petition is filed aggrieved by the action of the respondents 2 & 3 in disconnecting the power supply to the petitioner’s agricultural service connection bearing No.6144201000116 of Billanapalli Distribution at the instance of the 5th respondent as illegal, arbitrary etc., and for consequential direction to restore the same.

2. At the time of admitting the matter, the respondents vide interim order dated 24.01.2013 were directed to restore the electrical power supply provided that there are no arrears of consumption and demand charges with regard to the service connection in question.

3. In the counter-affidavit of respondent No.3, it is inter alia stated that the 5th respondent vide letter dated 22.01.2013 forwarded the report of V.R.O., wherein it was stated that the petitioner dug a bore-well in the Government land, which is against the public interest and the locals have raised objections to it. It is also stated that the 5th respondent has directed the 3rd respondent / Additional Assistant Engineer, SPDCL to disconnect the electricity connection.

4. The respondent No.5 has not filed any counter. It appears that the power supply to the subject matter service connection was disconnected only with reference to the said communication. No material is placed on record to substantiate that the 5th respondent had passed any orders on the basis of which, the power supply was disconnected, except a mere communication.

5. Be that as it may. Pursuant to the orders dated 24.01.2013, it appears that the power supply to the petitioner’s bore well / service connection was restored.

6. In the above stated position, this Court, instead of keeping the writ petition pending and further adjudicating the matter, deems it appropriate to dispose of the same, providing that in the event, the respondents intend to initiate any action with reference to the subject matter service connection, they shall follow the due procedure as contemplated under the Law and the Regulations.

7. Accordingly, the writ petition is disposed of. No costs. Consequently, all pending applications shall stand closed.
