ORDER:

The instant Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, by the Petitioner/Accused, to release him on bail in connection with the Crime No.100 of 2025 of Bommuru Police Station.

The brief facts of the case are that on 29.03.2025 at 8.00 a.m. at ‘O’ point, NH-216-A road, Diwancheruvu village, Rajanagaram Mandal, the Inspector of Police, Bommuru Police Station while conducting raid apprehended the accused when he was allegedly transporting 193.00 kgs of Ganja by Toyoto Corolla Altis car bearing No. DL 8 CAB 0690 and seized the said contraband, car and one cell phone and cash of Rs.100/- from the possession of the accused under the cover of mediator’s report.

Heard Sri Duggirala Subash, learned counsel for the Petitioner and Sri K.Sandeep, learned Assistant Public Prosecutor for respondent State. Perused the material on record.

Learned counsel for the petitioner would submit that the petitioner is innocent of the offence and no contraband has been recovered from his possession and that the Petitioner is an opting driver of the seized vehicle and no Ganja is recovered from his possession. Learned counsel would further submit that all the witnesses were examined and after completion of investigation, charge sheet has been filed, which is numbered as NDPS No.400 of 2025. Learned counsel would further submit that the petitioner is in jail since 29.03.2025 and prays to release the petitioner on bail.

On the other hand, learned Assistant Public Prosecutor on instructions would submit that earlier, petitioner filed a bail petition in Crl.M.P.Bail No.1293 of 2025, which was dismissed by the learned Judge, Family Court-cum-IX Additional District Judge, FAC I Additional Sessions Judge, Rajamahendravaram by order dated 08.12.2025. Learned counsel for the Petitioner would further submit that petitioner also filed Crl.P.No.12980 of 2025 and this Court by Order dated 06.01.2026 dismissed the petition. Learned Assistant Public Prosecutor would further submit that since then, there are no changes of circumstances in the matter and prays to dismiss the petition.

At this juncture, learned counsel for the Petitioner requested for a direction to the trial Court to dispose of the matter expeditiously.

Having regard to the facts of the case and as rightly put by learned Assistant Public Prosecutor there are change of circumstances emanating to release the petitioner on bail. There are no merits in this Criminal Petition and the same is liable to be dismissed.

Accordingly, this Criminal Petition is dismissed. However, considering the request of the learned counsel for the Petitioner, there shall be a direction to the learned Judge, Family Court-cum-IX Additional District Judge, FAC I Additional Sessions Judge, Rajamahendravaram to dispose of NDPS No.400 of 2025 expeditiously, preferably within a period of three months from the date of receipt of a copy of this order.

Pending applications, if any, shall stands closed.
