ORDER:
The instant Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, by the Petitioner/Accused No.3, to release him on bail in the event of his arrest in connection with the Crime No.173 of 2025 of III town Police Station.
The brief facts of the case are that on 17.12.2025 at 13.00 hours beside Prathamanandi Arch, near ‘Y’ Junction, Nandyal town, the Police arrested Accused Nos.1 and 2 and seized 2.728 grams of Ganja from their possession. During interrogation, A.1 confessed that he purchased the said substance from A.5 and supplied the same to A.2 to A.4. The Police seized the ganja from their possession and also seized 02 cell phones and a car (shift D’zire) from the possession of A.1 under the cover of Panchanama in the presence of Panchayatdars.
Heard Sri Murali Lincoln, learned counsel for the Petitioner and Sri K.Sandeep, learned Assistant Public Prosecutor for respondent State. Perused the material on record.
Learned counsel for the Petitioner would submit that the petitioner herein is arrayed Accused No.3 and he was implicated in this case based on the confession statement of the accused No.1 while he was in jail. Further, the contraband is recovered from the possession of A.1 and A.2 and no contraband is seized from the petitioner of this Petitioner/A.3 and no single averment is made against this petitioner. Learned counsel would further submit that the petitioner is not present at the scene of offence and prays to enlarge the petitioner on bail in the event of his arrest.
On the other hand, learned Assistant Public Prosecutor on instructions would submit that A.1 to A.2 were arrested by the Police while they were in possession of 2.728 grams of contraband and on the confession made by A.1 and A.2, A.3 to A.5 were arrayed as Accused. Further, two more cases under the provisions of NDPS Act, are pending against the Petitioner and the petitioner does not serve for anticipatory bail.
Considering the submissions made, and as rightly put by learned Assistant Public Prosecutor, the case lodged against the petitioner is primarily based on the confession of the A.1 and A.2, who were arrested while they were in possession of the contraband. Investigation is not yet completed to decide the role of the petitioner /A.3 in the matter. Admittedly, petitioner did not reveal about pendency of two more NDPS cases against him. In the circumstances, the petitioner does not deserve for anticipatory bail and the Criminal Petition is liable to be dismissed.
Accordingly, this Criminal Petition is dismissed.
Pending applications, if any, shall stands closed.
