ORDER:

This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the Petitioner herein/Accused No.2, seeking regular bail, in Crime No. 32/2026, dated 19-01-2026 of P.M.Palem Police Station, registered for the offences punishable under Sections 69 and 89 of Bharatiya Nyaya Sanhita (for short “BNS”).

2. The prosecution case, in brief, is that the victim became acquainted with the accused in 2017. While residing in a shared room with her friends at Visakhapatnam since September 2024, the accused expressed his love in February 2024 and they entered into a live-in relationship. Believing his promise of marriage, she developed physical relations with him. When she later became pregnant and requested him to marry her, the accused avoided the request and forced her to undergo an abortion. Thereafter, he distanced himself from her and ultimately denied their relationship, thereby cheating her.

3. None represented on behalf of the petitioner/accused. The petitioner herein has been in judicial custody since 20.01.2026. Since this is a regular bail application, this Court is inclined to proceed with the matter as the right and liberty of the individual is involved.

4. Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State would submit that the investigation is at crucial stage. The matter is pending for examination of some crucial witnesses. Medical examination is not completed. Investigation is pending to unearth the persons who did abortion to the victim woman at the instance of the accused in this matter. The petitioner has been in judicial custody since 20.01.2026. Since the investigation is at nascent stage, if the petitioner/accused is released on bail, there is every possibility to interfere in the investigation and tamper the evidence. She finally prays for dismissal of the petition.

5. In view of the above submissions and considering the nature and gravity of the offence alleged against the petitioner, this Court is of the opinion that no grounds are made out for granting regular bail to the petitioner at this stage.

6. Accordingly, this Criminal Petition is dismissed.

As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
