ORDER:

This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the Petitioner herein/Accused No.2, seeking regular bail, in Cr. No. 08/2023, Mothugudem Police Station, registered for the offences punishable under Sections 8(c) and 20(b)(ii)(C) of NDPS Act.

2. When the matter was taken up for hearing, Ms. Y.V.L. Gayathri, learned counsel, appeared before this Court and submitted that the bail application of the present petitioner is pending before the Trial Court. She would further submit that the learned counsel on record, Ms. Koppisetti Parvati Devi, had filed the present petition by forging the signature of the accused’s brother. The brother of the accused, Sri Nihar Haldar, appeared before this Court and filed an affidavit to that effect.

3. In reply, Ms. Koppisetti Parvati Devi, learned counsel on record in the present petition, appeared before this Court through V.C., and disowned the petition, and would submit that by forging her signature, someone might have filed the petition.

4. Considering the submissions made, this Criminal Petition is dismissed, since the bail application for the very same accused is pending before the Trial Court. However, the Registrar (Judicial) is directed to look into the issue and take appropriate steps according to law.

As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
