Order:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following prayer; “….to Issue a Writ of Mandamus or any other appropriate writ, order or direction, declaring the action of the 1st Respondent in issuing Lr.No.2036775/FIN01-HR0MISC/25/2023-hr-lll dated: 05- 11-2025 in not considering the service rendered by the writ petitioners prior to absorption into grant-in-aid service i.e., 01-03- 1991 and not counting the same for pensionary benefits without proper consideration of the orders passed in W.A.No.408 of 1999 and Circular

memo No. FIN01-HROMISC/25/2023-HR 111/2036775, dated 28-05-2023 is illegal arbitrary and violation of principles of natural justice and consequently set-aside the same and direct the 1st and 2nd respondents to count the services rendered prior to absorption i.e., 01-03-1991 for the purpose of pensionary benefits as ordered by the Division bench in W.A.No.408 of 1999 dated 08-04-2002 and pass.”

2. The case of the petitioners is that petitioners were appointed in between 1981 to 1985, were later recognized as regular lecturers with service benefits, but the authorities refused to count their service before 1991 for pension despite court orders, leading to the present writ petition.

3. Today, when the matter is taken up for hearing, it is submitted by the learned counsel for the petitioners, that the subject matter of this Writ Petition is squarely covered by the order passed by the Hon’ble Division Bench of the erstwhile High Court of Andhra Pradesh in Writ Appeal No.408 of 1999 and batch, dated 08.04.2002.

4. Following the said order passed by the Hon’ble Division Bench of the erstwhile High Court of Andhra Pradesh in Writ Appeal No.408 of 1999 and batch, dated 08.04.2002, and for the reasons mentioned therein, this Writ Petition is also disposed of directing the respondents to take into consideration the entire length of service put in by each one of the petitioners, including the service rendered by the petitioners prior to the year 1991 while fixing their pension. No order as to costs.

As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed.
