NDENT(S):

The Court made the following order:

Heard Sri Shivedi, learned counsel representing Sri N.Siva Reddy, learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for the respondents.

2. The grievance of the petitioners is against the action of the respondents in proposing to alienate the lands in Sy.Nos.419/1, 419/2, and 419/3 of Koyyam Village, Etcherla Mandal, Srikakulam District, after converting the classification of the said lands in the revenue records, in favour of beneficiaries identified under the “Navaratnalu Pedalandariki Illu” Scheme introduced by the Government of Andhra Pradesh during the relevant period.

3. It is the contention of the petitioners that the total extent of Ac.6.13 cents in Sy.No.419 was sub-divided. Out of the said extent, Ac.0.33 cents in Sy.No.419/1 was assigned under D-Form Patta to the 2nd petitioner and Ac.0.51 cents in Sy.No.419/3 was also assigned to her by the Government after considering her eligibility. It is further submitted that an extent of Ac.2.07 cents in Sy.No.419/3, along with the remaining land therein, was assigned to other beneficiaries.

4. It is also submitted that Ac.1.00 cents in Sy.No.419/1 was assigned to the 1st petitioner under D-Form Patta in the year 2001, the total extent in Sy.No.419/1 is Ac.2.82 cents. An extent of Ac.1.24 cents in Sy.No.419/2 was classified as “Banda” (Water Logged Area) and, as such, the same was not assigned to anyone under D-Form Patta. Water from the said Banda has been used by the assignees for their agricultural operations. But, the respondents, under political pressure, have proposed for conversion of the said Banda as house sites for making assignment. Aggrieved by the same, the petitioners have approached this Court by way of the instant writ petition.

5. Today, when the matter was taken up for consideration, the learned Assistant Government Pleader for Revenue appearing for the respondents has placed before the Court a copy of the written instructions received from the 4th respondent, dated 20.02.2026. A perusal of the same would reflect that Sy.Nos.419/1, 419/2, and 419/3 of Koyyam Village have not been proposed for issuance of house site pattas. It is stated that the petitioners, under an erroneous apprehension, approached this Court and filed the present writ petition.

6. It is further stated that the subject land is classified as “Banda”, which is a water body and in view of the directions of the Hon’ble Supreme Court of India to retain and restore water bodies, the same cannot be altered.

7. Having regard to the submissions made by the learned Assistant Government Pleader for Revenue, this Court is of the view that as there is no proposal for classification of the subject lands and the grievance of the petitioners is resolved. The written instruction of the 4th respondent is made part on record.

8. In view of the foregoing, the Writ Petition is disposed of as no further orders are required to be passed. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed. _______________________________ JUSTICE KIRANMAYEE MANDAVA
