ORDER:-

The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the Petitioner/Accused No.3 for grant of anticipatory bail in connection with Crime No.9 of 2026 of B. Kothakota Police Station, Annamayya District, registered for the offence punishable under Sections 308(5) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023.

2. Case of the prosecution, in brief, is that, on 23.01.2026 at about 10.00 PM., near Uday Bar & Restaurant, on PTM Road, B. Kothakota Town, accused Nos.1 to 3 were came on their bike and stopped the complainant car and pulled him down, threatened him that they would kill him, if he did not give money, then forcibly pulled his shirt and took Rs.2,000/- from his pocket and threatened him that if tell anyone about this, they will kill him and fled from there on their bike. Based on the report given by the defacto complainant, the police registered a case against the petitioners.

3. Heard learned counsel for the Petitioner and the learned Assistant Public Prosecutor representing the Respondent-State.

4. Learned counsel for the Petitioner would submit that the petitioner is falsely implicated in the present crime. He would further submit that the petitioner is a student pursuing Degree and in the event of any coercive action taken against him, it may affect his career and there are no criminal antecedents against the petitioner, he is ready to furnish sureties to the satisfaction of the Court. Learned counsel finally prays to allow the petition.

5. Learned Assistant Public Prosecutor vehemently opposed the petition by stating that specific allegations are made against the petitioner and hence, prays for dismissal of the petition.

6. On hearing both sides and on perusal of the material on record, it is seen that the allegation made against the petitioner is that he along with A1 and A2 stopped the defacto complainant car and forcibly taken money from the defacto complainant and also threatened him to kill him.

7. In the said facts and circumstances of the case, and in view of the prima facie allegations made against the petitioner and the nature of the offence, this Court is of the view that it is not a fit case to grant anticipatory bail to the petitioner.

8. Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous applications pending, if any, shall stand closed. ___________________________________
