ORDER:
During the course of hearing, learned counsel for the petitioner fairly admitted that the petitioner has not submitted application seeking deletion of her land situated in Sy.No.312 of D.R.No.133/1397 of Kapuluppada Village of Bheeminipatnam Mandal of Visakhapatnam District from the prohibitory list. Learned counsel for the petitioner further submits that petitioner is willing to file a fresh application and requested the Court to direct respondent authorities to consider this application and pass appropriate orders within a specified time.
2. The learned Assistant Government Pleader has no objection to this request.
3. In view of the above submission, without entering into the merits of the case, the Court finds it appropriate to dispose of the Writ Petition with the following directions:
(i) The petitioner is directed to submit an application to the 2nd respondent, within one week from the date of receipt of a copy of this order, seeking deletion of her land situated in Sy.No.312 of D.R.No.133/1397 of Kapuluppada Village of Bheeminipatnam Mandal of Visakhapatnam District from the prohibited list;
(ii) Upon receipt of such an application, the respondent authorities shall consider the same and pass appropriate orders, in accordance with law, after
providing a reasonable opportunity of hearing to the petitioner, within a period of two (2) weeks thereafter.
4. Accordingly, with the above observation, the Writ Petition is disposed of. No order as to costs.
Consequently, Miscellaneous Applications pending, if any, shall stand closed.
