APHC010106932026 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI Writ Petition No: 5736 of 2026 along with Writ Petition No.5409 of 2026 Bench Sr. Nos.:- LM-1 & 66

Writ Petition No: 5736 of 2026 M. Aiswarya ...Petitioner Vs. The State of Andhra Pradesh and others ...Respondents ********** Advocate for Petitioners: Mrs. Marella Radha, Mr. P. Nagendra Reddy (WP/5409/2026) Advocate(s) for Respondent(s): GP for Medical Health & FW, Mrs. Tata Venkata Sridevi, Standing Counsel For Dr.NTR University of Health Sciences CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R. RAGHUNANDAN RAO DATE : 26th February, 2026. P C : We have heard learned counsel for the parties.

2. The contention of the petitioners in the present petitions is that although they were eligible to be considered for admission in the stray vacancy round for PG (Medical) Courses in the State, they could not apply within time, inasmuch as they had already applied for PG Courses under the All India

HCJ & RRRJ WP_5736_2026 & WP_5409_2026 Quota and were under an impression that State Quota would be released only after the completion of the selection process under the All India Quota.

3. It is further contended that the University ought not to have advertised the vacancies in the stray vacancy round unless and until the process of selection under the All India Quota had been complete.

4. Learned counsel for the petitioners have not been able to satisfy us with regard to any statutory restriction on the part of the University in prescribing a cut-off date for inviting applications to fill the stray vacancies under the State Quota, even prior to the completion of the All India Quota process.

5. It is not out of place to mention that, as reported to us by learned Standing Counsel for the University, as many as three notifications were issued by the University, initially on 13.01.2026, inviting applications to fill the stray vacancies, which was followed by yet another notification, dated 19.01.2026, extending the time for receiving of applications up to 22.01.2026, and finally a third notification dated 16.02.2026, wherein time was extended up to 18.02.2026.

6. The petitioners clearly did not avail themselves of the opportunities liberally granted by the University.

7. It is stated by learned Standing Counsel for the University that the process of filling up the stray vacancies in the State has since been completed yesterday, i.e. on 25.02.2026.

HCJ & RRRJ WP_5736_2026 & WP_5409_2026

8. Considering the timelines within which the process of selection is required to be completed in terms of the various pronouncements of the Apex Court, as also the regulations of the MCC, we are of the opinion that no interference is warranted in the facts and circumstances of the present cases.

9. The Writ Petitions are found to be without merit and are accordingly dismissed. No costs. Pending miscellaneous applications, if any, in these cases, shall stand closed. DHIRAJ SINGH THAKUR, CJ. R. RAGHUNANDAN RAO, J. SSN
