Order:

The Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), by the petitioners, who are Accused Nos.1 and 5, seeking anticipatory bail in connection with Crime No.444 of 2025 of Sarpavaram Police Station, Kakinada District, registered for the offences under Sections 329(3), 74, 308(5), 351(3) read with 3(5) of BNS.

2. Case of the prosecution, in brief is that the complainant on 17.11.2025 at 06.00 p.m., lodged report stating that she and her brother purchased 600 sq. yards of vacant land in Kakinada under Registered Sale Deeds from Smt. Nattla Raghavamma in the year 1988. On 12.10.2025 at about 3.30 p.m., one Katru Nagababu along with two others trespassed into the property, abused her, threatened to kill her and forcibly extorted the gold chain from her neck. On the same day, at about 5.30 p.m., all the accused and others armed with deadly weapons, criminally trespassed into the complainant’s property. The accused persons allegedly created forged documents in an attempt to fraudulently occupy the land.

3. Heard Sri Dasani Venkataramana, learned counsel for the petitioners and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor representing the respondent/State.

4. Learned counsel for the petitioners would submit that the petitioners are falsely implicated in the present crime. The ingredients of offences under

Sections 329(3), 74, 308(5), 351(3) read with 3(5) of BNS does not attract to the present case. Only basing on the false allegations, the petitioners are roped into the present crime. The petitioners are ready to furnish sureties to the satisfaction of the Court to secure their presence and hence, prays to allow the petition.

5. Learned Assistant Public Prosecutor would submit that investigation is at nascent stage and there are specific accusations against the petitioners herein and hence, prays for dismissal of petition.

6. A perusal of the material on record would show that there are specific accusations against the petitioners herein that the petitioners with common intention criminally intimidated the complainant and caused mischief, abused her, threatened to kill her and forcibly extorted her. Learned Assistant Public Prosecutor would submit that investigation is at nascent stage and there are specific accusations against the petitioners that they threatened to kill the complainant. Taking into consideration of the stage of the investigation and severe accusations leveled against the petitioners, this is not the stage to consider the plea of the petitioners for anticipatory bail.

7. Accordingly, the Criminal Petition is dismissed.
