ORDER

This Criminal Revision Case is filed by the petitioners under Section 397/401 of Code of Criminal Procedure. Challenging the order, dated 29.12.2023 passed in Crl.M.P.No.65 of 2023 in F.C.O.P.No.246 of 2019 on the file of the Court of learned Judge, Family Court-cum-V Additional District Judge, Tirupati.

2. Heard M/s Sri K.Aruna, learned Counsel for the Petitioner, learned Public Prosecutor (AP) and Smt. Y.Maha Lakshmi, learned counsel for the respondents.

3. Learned counsel for the petitioner would submit that the petitioner herein is the husband who preferred this Revision against the common order passed by the learned Judge in F.C.O.P.No.246 of 2019 on the file of Family Court-cum-V Additional District Judge, Tirupati in Crl.M.P.No.65 of 2023 and 66 of 2023 vide orders dated 29.12.2023 wherein the petition filed by the petitioner to condone the delay in filing the petition to set aside the ex parte order passed in F.C.O.P.No.246 of 2019 granting maintenance at the rate of Rs.20,000/- per month to the wife, dismissed. Learned counsel for the petitioner herein is IV Grade employee in Railways and now retired. Learned counsel for the petitioner would further submit that however the Court is not inclined to interfere in the Revision, liberty may be given to the petitioner to work out his remedy before the Trial Court according to law.

4. Learned counsel for the respondents would submit that the Court may pass appropriate orders, as the impugned order is a well-reasoned order and there is nothing warranting interference in revision.

5. Considering the submissions made and a cursory look at the impugned order would show that the learned Judge has taken pain to mention everything in the common order about receipt of notice in the matter. Appearance of the party before the Court, but did not chose to file a counter in the matter. Thereafter, the petitioner herein did not chose to contest the matter and making the Court to take a decision ex parte and in that process the Court granted maintenance at the rate of Rs.20,000/- per month to the respondent No.2/wife. As rightly put by the learned counsel for the respondent, there are no ground to intervene in the impugned order.

6. In that view, the petition is dismissed. However, the petitioner is at liberty to work out the remedy before the Trial Court according to law, in the light of change of circumstances.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________ Dr. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 24.02.2026 RMR
