2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for respondents.

3. The petitioner was initially appointed in the revenue department as Village Administrative Officer at Garividi Village on honorarium basis vide proceedings Rc.No.939-92/H dated 31.01.1992. At that point of time, owing to some certain discrepancies, on 28.04.2000 a criminal case was registered against the petitioner and the Village Administrative Officer of Sadanandapuram Village in Crime No.33 of 2000 on the file of Gurla Police Station. Subsequently, the petitioner had attended counseling on 26.12.2001 and 27.12.2001 and accordingly he was selected as Panchayat Secretary for Pattikayavalasa Village of Cheepurupalli Mandal by the District Selection Committee. Because of the pendency of the criminal case, the respondents have not considered at first and subsequently his case was considered and appointed as Panchayat Secretary on 23.10.2006. In the said circumstances, the petitioner is entitled for notional appointment and according he made a request. Considering the request and also the orders passed by S.C.No.28 of 2001 on the file of the learned I Additional Sessions Judge, Vizianagaram, the 5th respondent has recommended the case of the petitioner for notional regularization vide communication dated 06.03.2023 to the 3rd respondent. Despite lapse of three years, the respondents have not considered and passed any order. Hence, the Writ Petition.

4. Considering the submissions made and on perusal of the record, this Court finds that no specific recommendation has been made by the 5th respondent on 06.03.2023.

5. Without going into merits of the case, this Writ Petition is disposed of directing the 3rd respondent to consider the communication dated 06.03.2023 from the 5th respondent and pass appropriate orders, as per the record. The said exercise shall be completed within a period of two (02) weeks from the date of receipt of a copy of this order.

There shall be no order as to costs. As a sequel, miscellaneous petitions, pending if any, shall stand closed.
