...RESPONDENT(S):

The Court made the following ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: to issue a writ, order or direction more particularly one in the nature of mandamus declaring the action of the respondents in trying to proceed further for promotion to the post of Associate Professor of pediatric spursuant to final eligibility seniority list dt. 29.01.2026 without considering the objections/representation dt. 30.01.2026 made by the petitioner is as illegal, arbitrary. Violation of article 14 and 21 of the Constitution of India and procedure prescribed under the law and to Consequently direct the respondents to consider the candidature of the petitioner for promotion to the post of Associate professor for pediatric as per National Medical commission notification DT 30-6- 2025 as well as G.o.ms. no. 222 DT 15-12-2023 and pass such

2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

3. The case of the petitioner is that the respondents are proceeding with promotions to the post of Associate Professor of Pediatrics pursuant to the final eligibility/seniority list dated 29.01.2026, without considering the objections/representation dated 30.01.2026 submitted by the petitioner.

4. The learned counsel for the petitioner submits that the respondents had initially prepared a provisional seniority list for the post of Associate Professor of Pediatrics for the panel year 2025–2026, comprising candidates who had completed four (04) years of service as on 01.09.2025, wherein the petitioner was placed at Serial No.13. However, in the final seniority list dated 29.01.2026, the petitioner has been placed at Serial No.26, and certain juniors to the petitioner have been placed above him. Aggrieved thereby, the petitioner submitted objections/representation dated 30.01.2026 to the respondent authorities. However, without considering the objections raised by the petitioner, the respondents are proceeding further with the promotion process.

5. Considering the above, this Court is not inclined to go into the merits of the case. Accordingly, the writ petition is disposed of with a direction to the respondent authorities, more particularly the 4th respondent, to consider the objections/representation dated 30.01.2026 submitted by the petitioner and to pass appropriate orders thereon within a period of four

(04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed. ________________________ JUSTICE D RAMESH 18.02.2026
