Veerannakanupuru Bit-1, Venkatachalasatram Village, Venkatachalam Mandal, SPSR Nellore District, without following due process of law.

3. It is contended that the petitioners have acquired the subject lands by inheritance and some of them have purchased vide registered sale deeds in and around 1987-1988, and have been in occupation of the subject lands and have constructed residential buildings.

4. It is contended by the learned counsel for the petitioners that the respondents without having authority over the land tried to level the lands and interfere with the peaceful possession and enjoyment of the subject property. Aggrieved by the same, the instant writ petition is filed.

5. Today, when the matter is taken up for consideration, the learned Assistant Government Pleader for Revenue appearing for the respondents has placed before the Court a copy of the written instructions received from the 4th respondent dated 31.01.2026. A perusal of the same would reflect that the Resurvey Settlement Register (RSR) of the Village Kanupur Bit-I, Sy.No.667/3 with an extent of Ac.74.80 Cents has been notified in the name of “Venkatachalam Satram Trustee Mallavarapu Subbarao” under the provisions A.P. Charitable and Hindu Religious Institutions and Endowments Act (Act 30 of 1987), and same has been published in the list of prohibited land under Annexure 22 (A) (1)(c) of the Registration Act, 1908. It is further stated that the said institution has been registered under the provisions of Section 6(C) of the Andhra Pradesh Charitable and Hindu Religious Institutions and

Endowments Act, 1966 and the Endowment Department is the appropriate authority to deal with the subject land not the Revenue Department. And in the past in 2007, the Deputy Commissioner of Endowments had directed the Assistant Commissioner of Endowments to take steps to evict the petitioners from the subject lands.

6. Having regard to the above, this Court is of the view that if the petitioners are found to be in unlawful possession and enjoyment of the subject lands, any action for their displacement or dispossession shall be in accordance with law after providing due opportunity to the petitioners.

7. In view of the above, the Writ Petition is disposed of, directing the respondents to follow due procedure under law if any action for dispossession of the petitioners is proposed in respect of the subject lands after providing due opportunity to the petitioners. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
